Azayn Health Terms of Service

1. Agreement

These Terms are a contract between you and the provider named in our Legal information ("Azayn", "we") governing the Azayn Health apps and website (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use it for an organisation, you confirm you can bind it.

2. Who can use Azayn Health

You must be at least 18 years old and able to form a binding contract. You must provide accurate information, including your date of birth. We may suspend or delete accounts that provide false information or that belong to someone under 18. Azayn Health is not offered where the law prohibits it.

3. Your account and security

You sign in with a one-time code sent to your email, or with Apple, Google or Microsoft. You are responsible for your mailbox and devices and for activity on your account. Tell us at support@azayn.com if you suspect unauthorised access. We email you when a new device signs in; if that was not you, act on it.

4. What Azayn Health is, and is not

Azayn Health is a personal health and fitness logbook that lets you record data, optionally sync it from your phone, and choose to share it with independent fitness trainers.

Not medical advice

Azayn Health is not a medical service and does not diagnose, treat, cure or prevent any condition. Content in the Service, including anything a trainer tells you, is for general fitness and wellness information only and is not a substitute for professional medical advice, diagnosis or treatment. Consult a physician before starting any exercise, nutrition or weight programme, especially if you have a medical condition, are pregnant, or take medication. Stop and seek medical help if you feel pain, dizziness or distress. In an emergency call your local emergency number. Do not use Azayn Health. Data from phones and wearables can be inaccurate; do not rely on it for medical decisions. You use any plan, exercise or guidance at your own risk.

5. Trainers

Trainers are independent professionals, not employees, agents, partners or representatives of Azayn. We review documents submitted by people who apply as trainers, but we do not guarantee a trainer's qualifications, licensing, insurance, competence, results or conduct, and a review is not an endorsement. The relationship, advice and any services between you and a trainer are solely between you and them. We are not responsible for a trainer's advice, acts or omissions. Verify a trainer's credentials yourself and apply your own judgement. We do not currently process payments between you and a trainer.

You control what a trainer sees (section 6). You can end a connection at any time and access stops immediately. Do not share health information in a post if you do not want it public.

6. Your data and sharing

You own your data. You grant us the limited rights needed to host, process and display it to run the Service and to carry out your sharing choices. A trainer you have connected with, and who accepted, can see the categories switched on in Profile → Sharing. For new accounts, every category except AI workout progress is switched on by default, so review the settings when you connect. You can switch categories off, or end the connection, at any time. Workout routes are never shared with trainers. See the Privacy Policy.

7. Your content

  • Your responsibility. You are responsible for posts, photos, videos, notes and everything you upload. You confirm you own or have the rights to it and that it does not violate these Terms or the law.
  • Licence to us. You grant Azayn a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize or transcode, and display your content solely to operate and provide the Service to the audience you chose, for as long as the content is on the Service. This ends when you delete the content or your account, except for copies in backups for the period stated in the Privacy Policy and copies others have independently saved.
  • Public means public. Content set to "public" can be seen, shared and indexed by anyone.
  • No endorsement. We do not pre-screen content and are not responsible for user content.

8. Rules

You will not: break the law; harass, threaten, impersonate or exploit anyone; post sexual content, content involving minors in any sexualised context, graphic violence or hate; promote disordered eating, self-harm, dangerous "challenges" or unlicensed medical treatment; sell or promote dangerous or illegal substances, including unapproved performance-enhancing drugs; spam or scrape; share another person's health data without their permission; upload malware; probe, overload or circumvent the Service or its limits; access another person's data; use the Service to train a competing system; or misrepresent trainer credentials or your identity. Trainers must also follow the Trainer Terms (Schedule 1).

9. Reporting, moderation and enforcement

Anyone can report a post. Posts that receive multiple reports are automatically hidden pending review, and staff may remove content, restore it, reject or approve trainer applications, and suspend or terminate accounts. We act at our discretion and do not promise to review any report within a set time or to remove any particular content. You can block users. To report illegal content, a security issue or a safety concern, email support@azayn.com and tell us what the content is, where it is (a link), and why you believe it is unlawful. If someone is in danger, call emergency services first.

10. Plans, payments and subscriptions

Plans. The Service has a Free plan and paid plans. Their features and prices are shown in the App at purchase. We may change prices and features with notice; a price change applies from your next renewal.

Where you buy matters.

  • Apple App Store / Google Play. Purchases are processed by Apple or Google, whose terms and refund policies apply. Subscriptions renew automatically at the displayed price for the same period until you cancel at least 24 hours before the end of the current period (Apple), or as Google Play requires. Manage or cancel in your App Store or Google Play subscription settings; deleting the App or your Azayn Health account does not cancel it. Refund requests go to Apple or Google.
  • Web (Stripe). Billed by Stripe. It renews automatically until cancelled; cancel in the App's plan settings. Cancellation takes effect at the end of the paid period. Payments are non-refundable except where the law requires otherwise; as a consumer in the EU or UK you have the statutory right of withdrawal described below.
  • Free trials and promotions, if offered, convert to paid unless cancelled as described at sign-up.

Right of withdrawal for consumers in the EU and the UK. If you are a consumer and you buy a subscription on the web, you may withdraw within 14 days without giving a reason by telling us clearly, by email to support@azayn.com. We then repay what you paid, within 14 days, using the payment method you used. If you asked for the paid features to start during the 14 days and then withdraw, you pay for the part already provided, proportionally. Purchases through Apple or Google are governed by their terms.

Token bundles (for example username-change tokens) are one-time digital purchases, non-refundable except as required by law or by the store, have no cash value, are not transferable, and are forfeited if your account is deleted.

Taxes are included or added as shown at checkout.

Consumer rights. Nothing here limits mandatory consumer rights where you live.

11. Intellectual property

The Service, its software, design, trademarks and content we provide are owned by Azayn or its licensors and are protected by law. We grant you a personal, limited, revocable, non-transferable licence to use the App for your own purposes. You may not copy, modify, reverse engineer or resell it except as the law permits. Feedback you give us may be used without obligation to you.

Copyright and other complaints. If you believe content on Azayn Health infringes your rights or is unlawful, email support@azayn.com with: your name and contact details; what the content is and where it is; why you believe it infringes your rights or is unlawful; and a statement that you are acting in good faith and that your information is accurate. We may remove content and will terminate the accounts of repeat infringers. The person who posted it can respond to us in the same way.

12. Third-party services

The Service relies on and links to third parties (Apple, Google, Microsoft, Stripe, map providers, your phone's health platform, trainers). Their terms govern your use of them; we are not responsible for them.

13. Suspension, termination and deletion

You may stop using Azayn Health at any time and ask us to delete your account by emailing privacy@azayn.com from your account's address. Deletion works as described in the Privacy Policy. We may suspend or terminate your access for breach of these Terms, risk to others or the Service, a legal requirement, or prolonged inactivity, and may remove content. Sections that by nature survive (ownership, disclaimers, liability, disputes) survive termination. Termination does not refund prepaid amounts except as required by law.

14. Warranty

For paying consumers, the statutory warranty rights for digital products apply. Otherwise the Service is provided as it is and as available. We do not promise any fitness result, the accuracy of data (including data from third-party devices), or the conduct or advice of any trainer or user.

15. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health caused by us, under the Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only for breach of an essential contractual obligation (one whose fulfilment makes the proper performance of the contract possible and on which you may regularly rely), and then only for the foreseeable damage typical for this kind of contract. Otherwise we are not liable for slight negligence. We are not liable for the advice, acts or omissions of trainers or other users, or for injury arising from exercise or guidance you chose to follow. If you are a business, our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100, as far as the law permits. This does not affect mandatory rights you have under the law of your country.

16. Your responsibility for content

You will compensate us for third-party claims that arise from your content, your breach of these Terms, or your violation of the law or of others' rights, as far as the law permits and where you are responsible for the breach.

17. Governing law and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live remain unaffected, and you may bring a claim in the courts of your place of residence. If you are a business, the courts at our place of business, as stated in the Legal information, have exclusive jurisdiction, as far as the law permits.

18. Apple and Google terms

These apply if you obtained the App from the Apple App Store; they are Apple's required minimum terms. (a) These Terms are between you and Azayn, not Apple; Azayn, not Apple, is responsible for the App and its content. (b) Your licence is limited to use on Apple-branded products you own or control, under the Usage Rules in the App Store Terms. (c) Apple has no obligation to provide maintenance or support. (d) If the App fails to conform to a warranty, you may notify Apple for a refund of the purchase price; to the maximum extent permitted by law Apple has no other warranty obligation, and other claims, losses and costs are Azayn's responsibility. (e) Azayn, not Apple, handles claims about the App (product liability, legal compliance, consumer protection, privacy) and intellectual-property infringement claims. (f) You represent that you are not in a country subject to a U.S. embargo or on a U.S. prohibited or restricted list. (g) You must comply with applicable third-party terms (for example your wireless carrier's). (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you once accepted. Questions or complaints: support@azayn.com. Google Play purchases are additionally subject to Google Play's terms.

19. Changes to the Service and Terms

We may change the Service and these Terms for good reason, such as legal changes or new features. For material changes we will give notice (including in the App) and ask you to accept the updated Terms. If you do not accept, stop using the Service and ask us to delete your account.

20. General

If a provision is invalid, the rest stays in force. You may not assign these Terms; we may. We are not liable for events beyond our reasonable control. Notices to you are by email or in the App; notices to us go to support@azayn.com or to the address in the Legal information.

Schedule 1: Trainer Terms

These apply in addition to the Terms to anyone approved as a trainer.

  1. Eligibility and accuracy. You are at least 18 and (where the law requires it for the services you offer) licensed, certified or otherwise qualified; everything you submit, including identity, certificates and experience, is true, current and yours. You will tell us promptly if a credential lapses or is revoked. We may verify, reject, suspend or revoke approval at our discretion.
  2. Independent professional. You are an independent provider of your own services, not an employee, agent or partner of Azayn. You are solely responsible for your advice, qualifications, licences, insurance, tax, and compliance with the laws governing your profession and any health-related advice you give, including not practising medicine, dietetics, physiotherapy or any regulated profession without the required licence. We recommend professional liability insurance.
  3. Trainee data: confidentiality and purpose limitation. Health data a trainee shares is confidential and sensitive. You will use it only to advise that trainee; not sell, license, publish or use it for advertising or profiling, or to train systems; not share it with third parties except as the trainee has expressly authorised or the law compels; protect it with appropriate security; and stop using, and delete, data you have copied or exported when the connection ends or the trainee asks. You are responsible for your own compliance with privacy and professional-confidentiality laws as an independent handler of that data.
  4. Conduct. No sexual or romantic conduct toward trainees; no discrimination, coercion or harassment; no guarantees of medical results; no recommending dangerous practices or unapproved substances; clear, honest presentation of your credentials.
  5. Emergencies. If a trainee describes a medical emergency or a risk of self-harm, direct them to emergency services.
  6. Programs and content. Programs, guidance and reviews you create remain yours, licensed to Azayn to host and deliver as in section 7. If you delete your account, your programs, notes, guidance and their enrolments are deleted and affected trainees are notified.
  7. Liability. Sections 15 and 16 of the Terms apply to you as well, including your responsibility to us for your own acts.
  8. Staff access. Authorised Azayn staff may review your application documents and content for verification and safety. Identity documents are kept only as described in the Privacy Policy.
