Terms of Service

These terms cover this website and Air Mouse. Azayn Health has its own Terms of Service.

1. Agreement

These terms are between you and the provider named in our Legal information ("Azayn", "we", "us"). By using azayn.com, or by buying, installing or using Air Mouse, you agree to them and to our Privacy Policy. If you do not agree, do not use them.

2. The website

You may browse azayn.com for lawful purposes. Do not disrupt it, probe it for weaknesses without our written permission, or scrape it at a rate that affects other visitors. Information on the site may change.

3. Air Mouse

Air Mouse lets you control a Windows, macOS or Linux computer with your hand, using your phone's camera in the phone's browser. You need the Air Mouse desktop app, a phone with a browser and camera, and both on the same network.

3.1 Early preview

Air Mouse is new and offered as an early preview. Cursor feel is still being tuned on real hands and phones, and features may change. The macOS app is signed and notarized by Apple. The Windows installers are not code-signed yet, so Windows SmartScreen may warn you on first launch.

3.2 Licence

When you buy, we grant you a personal, non-exclusive, non-transferable licence to install and use Air Mouse on up to 10 computers that you own or control, for personal or business use, for as long as the licence is not revoked. Updates are provided for as long as we offer the version you bought; we do not promise future major versions.

The app stays locked until you enter your licence key. There is no free trial.
Your key is emailed to the address you bought with. Keep that email: it is the only copy we send automatically. You can ask for it again on the "re-send my key" page; we send it only to the purchasing address.
To use the licence on another computer, deactivate it in the app (Settings, then Licence) to free a slot, or contact us. Reinstalling in a way that erases the app's data counts as a new computer.
The app checks your licence with our server about weekly. A signed token keeps it working for up to 30 days without a connection.
You may not share, resell or publish your key, or work around the licence checks. We may revoke a licence that is used against these terms.

3.3 Price and payment

The price shown at checkout applies. The launch price is US$45, a one-time payment (regularly US$99). Prices include or exclude taxes as shown at checkout; where tax applies, it is calculated and added there. Payment is handled by Stripe. We never see your card details.

3.4 Refunds: 14 days, for everyone

You can get a full refund within 14 days of purchase, without giving a reason. Email support@azayn.com from the address you bought with. We refund the original payment method. The licence is then revoked, and Air Mouse locks at its next licence check (within about a week). After 14 days, purchases are final except where the law says otherwise. A partial refund does not change the licence. A full refund or a payment dispute (chargeback) recorded by Stripe revokes the licence automatically.

3.5 Right of withdrawal for consumers in the EU and the UK

If you are a consumer, you have a statutory right to withdraw from the purchase within 14 days without giving any reason. The period starts on the day of purchase. To withdraw, tell us clearly by email to support@azayn.com (for example, "I withdraw from my purchase of Air Mouse, bought with this email address"). It is enough to send the notice before the period ends.

If you withdraw, we repay everything you paid, without undue delay and at the latest within 14 days of receiving your notice, using the payment method you used. The licence is deactivated. We give the same 14 days to every customer under section 3.4, so you do not need to waive or confirm anything at checkout.

3.6 Camera and privacy

Hand tracking runs in your phone's browser; camera frames are not sent to your computer or to us. See the Privacy Policy. You are responsible for using the camera lawfully, for example not pointing it at people who have not agreed to it.

4. Support

Contact support@azayn.com. We aim to reply within two business days.

5. Ownership

Air Mouse, this website and their content belong to Azayn or our licensors. Apart from the licence in section 3.2, no rights are granted. Open-source components keep their own licences.

6. Warranty

For paying consumers, the statutory warranty rights for digital products apply. Otherwise, the website and Air Mouse are provided as they are and as available, and we do not promise that they will be uninterrupted or suit your particular hardware or purpose.

7. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only for breach of an essential contractual obligation (one whose fulfilment makes the proper performance of the contract possible and on which you may regularly rely), and then only for the foreseeable damage typical for this kind of contract. Otherwise we are not liable for slight negligence. This does not affect mandatory rights you have under the law of your country.

8. Suspension and ending

You may stop using Air Mouse at any time. We may revoke a licence or suspend access if you breach these terms, if a payment is reversed, or if the law requires it.

9. Changes

We may change these terms for good reason, such as legal changes or new features. We will post the new version here and tell purchasers by email. If you do not agree, you can stop using Air Mouse and use your right to a refund under section 3.4 if it is still open.

10. Governing law and courts

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live remain unaffected. If you are a business, the courts at our place of business, as stated in the Legal information, have exclusive jurisdiction, as far as the law permits.
